We process personal information only where we have a lawful basis to do so. Depending on the circumstances, we may process personal information based on your consent, the need to perform a contract or provide a requested service, compliance with legal or regulatory obligations, our legitimate business interests, safety and security needs, or the need to establish, exercise, or defend legal claims.
5. Information About Delivery Recipients
Customers who submit delivery requests may provide personal information about recipients, such as name, phone number, address, and delivery instructions.
By submitting recipient information, the customer confirms that they have the authority or appropriate reason to provide that information to Agility Delivery for the purpose of completing the delivery.
We use recipient information only as needed to complete the delivery, communicate about the delivery, confirm delivery status, handle support issues, and maintain appropriate delivery records.
6. Business Account Information
For business accounts, we may process information about the business, its authorized users, employees, customers, delivery recipients, billing contacts, and submitted delivery requests.
The business is responsible for ensuring that any personal information submitted to Agility Delivery is accurate, lawful, and provided with appropriate authority.
Business account administrators may be able to view delivery history, invoices, user activity, recipient information, and account-related information associated with the business account.
7. Sharing of Personal Information
We do not sell personal information.
We may share personal information only where reasonably necessary for the operation, management, protection, or legal compliance of our services.
We may share personal information with delivery drivers, couriers, logistics partners, Courier Connect partners, payment processors, banks, payment gateways, technology providers, hosting providers, analytics providers, software vendors, communication providers, professional advisers, government authorities, regulators, courts, law enforcement, or parties involved in a business transaction involving Agility Delivery or Agility Delivery.
Where we use service providers, we expect them to process personal information only as necessary to provide services to us and to apply appropriate confidentiality and security protections.
7.1 Referral Attribution and Partner Reporting
When a person uses a referral link and creates an account, Agility Delivery records the referral code, the referring partner, the referred customer account, and the registration date and source. Agility Delivery may retain this attribution internally under an appropriate documented lawful basis to administer the referral programme, prevent fraud, verify partner compensation, maintain audit records, and resolve disputes, even if the customer does not consent to customer-level disclosure.
With the customer's separate, optional consent, Agility Delivery may tell the referral partner that the customer registered and may share the customer's or business's name, whether the referral converted through a completed paid delivery, and whether the customer is active or inactive based on recent paid delivery activity.
Agility Delivery never shares delivery addresses, package or delivery details, payment information, transaction amounts, or other order-level information with referral partners through referral reporting.
If consent is declined or later withdrawn, the referral partner receives only aggregated or anonymized reporting. The customer's name and individual registration, conversion, and activity dates are not displayed. Consent is not required to create or use an Agility Delivery account and may be withdrawn from the customer's profile or by contacting Agility Delivery.
Referral attribution, consent, compensation, and related audit records are retained while the account or referral relationship remains active and for up to seven years after the later of account closure or the last referral-related transaction. Records may be retained longer where required or permitted by law, or may be deleted or anonymized when no longer required.
8. Delivery Partners and Independent Couriers
Where an independent courier, delivery partner, or third-party logistics provider is assigned to a delivery, we may share the information needed to complete that delivery, including sender details, recipient details, addresses, contact numbers, package information, delivery instructions, and proof-of-delivery requirements.
Delivery partners are expected to handle personal information confidentially and only use it for the assigned delivery or authorized Agility Delivery purpose.

Some of our technology systems, cloud services, payment providers, communication platforms, or business tools may process or store information outside Jamaica.
